Breaking: Executive Order Establishes Strategic Bitcoin Reserve and U.S. Digital Asset Stockpile

WASHINGTON — The White House has formally established a Strategic Bitcoin Reserve and a separate United States Digital Asset Stockpile under Executive Order 14233, signed March 6, 2025 and published in the Federal Register on March 11, 2025. The order directs that bitcoin deposited into the Reserve shall not be sold, marking the first time the federal government has designated a digital asset as a long-term sovereign holding.

Under the order, the Strategic Bitcoin Reserve is capitalized with bitcoin already owned by the Department of the Treasury that was forfeited in federal criminal or civil asset forfeiture proceedings. The U.S. Digital Asset Stockpile holds forfeited digital assets other than bitcoin. The two pools are treated differently: Reserve bitcoin is designated for retention as a store of value, while Treasury retains discretion over stewardship of Stockpile assets.

The order further directs the Secretary of the Treasury and the Secretary of Commerce to develop budget-neutral strategies for acquiring additional bitcoin, conditioned on imposing no incremental cost on American taxpayers. Federal agencies were directed to provide Treasury with a full accounting of digital assets in their custody.

Implications. The policy has direct consequences for federal custody and forfeiture practice. Agencies including the U.S. Marshals Service and DOJ have historically liquidated seized cryptocurrency through public auction; a no-sale directive changes the disposition path for forfeited bitcoin and raises operational questions about custody infrastructure, key management, and accounting treatment on the federal balance sheet. It also removes a recurring source of sell-side supply that markets had previously priced in.

What’s next. Watch for Treasury’s implementing guidance on custody and valuation, any congressional action to codify the Reserve in statute, and whether budget-neutral acquisition authority is actually exercised.
